A most concerning measure is that all employers with under 500 employees are required to pay employees choosing to take leave to care for children 18 years and younger whose school or child care is closed, at a rate of 2/3rds of their wages up to $200 per day for 10 weeks.

This “qualifying need” is limited to circumstances where an employee is unable to work (or telework) due to a need to care for a minor child if the child’s school or place of child care has been closed or is unavailable due to a public health emergency. There is a specific exemption for employees who are health care providers or emergency medical technicians and a potential exemption for businesses under 50 employees.
